This privacy notice (“Privacy Notice”) describes how QGenda, LLC and its affiliates (collectively “QGenda”, “we”, “our” or “us”) handle personal information obtained in connection with the operation of QGenda’s website, available at www.qgenda.com (the “Site”), and our offerings available through websites or mobile apps linking to this Privacy Notice that are provided to licensed customers (collectively, the “Offerings”).
This Privacy Notice describes how QGenda uses the personal information obtained in connection with the operation of the Site and Offerings, and with whom we may share it. The Site is made available for informational purposes and is intended for Site visitors, including prospective customers and Customers (as defined below), acting in a professional capacity.
This Privacy Notice does not apply to personal information that customers (e.g., hospitals and clinics) and their authorized users such as practice administrators or work force members (collectively, the “Customers”) submit through the Offerings. Such use and access are governed by the terms and conditions of the contractual agreements that Customers enter into with QGenda, as amended from time to time (the “Customer Agreements”). We encourage you to review the privacy notices and similar statements of the relevant Customers and any third-party systems through which the Offerings are made available to learn about their privacy practices. With respect to privacy rights you may have with regard to personal information Customers may collect and provide to QGenda for processing, please contact the applicable Customer directly to submit your request.

Provided by you to QGenda (e.g., completing a web form such as to request a demo, sign up for a newsletter or downloading a case study): (i) contact information (i.e., name, email, phone number); (ii) professional or employment information (i.e., job title, organization name); and/or (iii) other information provided in the free text fields on web forms, by email or otherwise.

Automatically collected: QGenda and our service providers may automatically obtain certain personal information when you access the Site from your web browser or mobile device, such as information about the number and frequency of visitors, technical information about browsers and devices used to access the Site, and information about crashes or other technical issues. In addition, we and third parties may automatically collect certain information through cookies and other technologies about your activities over time across the browsers and devices you use to access the Site as well as across third-party sites, apps, or other media. These technologies may assign or collect a unique identifier on your browser or device and may reside, among other places, on your computer or device, within webpages, mobile apps, emails, or other digital content.

The personal information that QGenda collects and processes depends on the Offerings and is governed by the respective Customer Agreements. It may include:

Customers’ personal information such as: (i) contact information (e.g., name, address, email address, phone number); (ii) login credentials; (iii) information you provide us when you open a support ticket, call customer support or complete your account profile; (iv) information about hours and location for shift adherence; and/or (v) other information you provide for certain products, such as NPI, date of birth, professional licensing information, Social Security number, educational background, work history or in free text fields; and

Automatically collected from usage of Offerings and data automatically logged (e.g., tracked hours, location, IP address).

To detect, prevent and respond to violations of this Privacy Notice, applicable Terms of Service, the Customer Agreements, violations of law, or other misuses of the Site or Offerings;

To comply, fulfill and enforce applicable contractual obligations or industry and legal requirements (including legal processes such as court orders, warrants, or subpoenas);

To generate analytic statistics about the use of the Site or Offerings to measure usage and improve functionality; and

To de-identify and/or aggregate the personal information and other data we obtain through the Site and with respect to the Offerings, to the extent permitted by our Customer Agreements (collectively, the “De-Identified Data”). The requirements and limitations described in this Privacy Notice on our collection, use, sharing, disclosure, transfer, and retention of personal information do not apply to such De-Identified Data as well as other information that cannot be used to identify you.
HOW QGENDA PROVIDES PERSONAL INFORMATION OBTAINED FROM THE SITE AND OFFERINGS TO OTHERS (BUSINESS OR COMMERCIAL PURPOSE FOR PROVIDING PERSONAL INFORMATION TO THIRD PARTIES AND OTHER ENTITIES)
QGenda may provide personal information obtained from the Site and, as applicable for the Offerings, in accordance with the Customer Agreement, as follows:
To our affiliates and subsidiaries;
To service providers that provide services on our behalf;
To marketing, advertising, and business partners (e.g., a co-sponsor of a webinar or event);
As necessary or appropriate to our attorneys, accountants, auditors, or other advisors;
As we believe is necessary or appropriate to protect, enforce, or defend our legal rights, the privacy or safety of our employees, visitors and users of the Site and Offerings or other individuals and entities, or to comply with or enforce applicable laws or legal process, including responding to court orders, warrants, subpoenas and other requests from public and government authorities;
To the extent reasonably necessary to proceed with the negotiation or completion of a merger, acquisition, or sale of all or a portion of our assets (including in the event of a reorganization, dissolution, or liquidation); and
To third parties for any purpose with an individual’s and/or a Customer’s consent or direction.
In addition, with respect to the Offerings we may provide personal information to the relevant Customer or others as directed by the Customer and as governed by the Customer Agreements and applicable law.
We use a variety of security technologies and procedures to help protect personal information from unauthorized access, use or disclosure. However, no method of transmission over the internet, or method of electronic storage, is 100% secure. Therefore, while we make reasonable efforts to protect your information, we cannot guarantee its absolute security.
The Site and Offerings may contain links to websites, mobile apps, or other services operated by companies not affiliated with QGenda. In addition, the Offerings may be made available to you through third-party systems or other channels including third-party platforms. We are not responsible for the collection or use of your personal information by such non-QGenda operated websites, mobile apps, or other services and channels, and we encourage you to review the privacy policies or other similar statements published by relevant third parties.

Industry maintained Opt-outs. To learn more about your rights in relation to interest-based advertising on your browser, including your choice to opt-out, you can follow the instructions provided by the Digital Advertising Alliance (“DAA”) here and/or the Network Advertising Initiative (“NAI”) here to place an opt-out cookie on your browser. These opt-out cookies enable you to block participating companies from installing future cookies on your device or browser. If you place opt-out cookies but subsequently clear or delete cookies on your computer or device browser, your opt-out cookies may be deleted, and you may have to renew your opt-out choices for that specific browser. The opt-out mechanisms offered by DAA and NAI are provided by third parties. QGenda does not control or operate these mechanisms, or the choices provided through these mechanisms.

Doximity Advertising Opt-Out for Shift Admin. In order to opt out of certain ads that you may receive in the Shift Admin Offering, you can submit an opt-out request by emailing ShiftAdminContentRequest@qgenda.com and including your full name, email address and stating that you would like to be opted out of receiving advertisements in Shift Admin.
Mobile App Opt-Outs

Device Settings. To limit targeted advertising on your mobile device, you can review and adjust the settings provided by your device manufacturer, such as guidance for iOS or guidance for Android.

AppChoices Application. You can download the “AppChoices” application provided by the DAA from your app store. AppChoices offers a mechanism to limit the collection of app data used for targeted ads by participating companies. See the AppChoices provided by the DAA for more information.
Do Not Track/Global Privacy Control
You may unsubscribe from our marketing and promotional communications and newsletters by clicking on the unsubscribe link in the email.
You may request that we stop sending you postal mail by notifying us in writing at QGenda, LLC, 3280 Peachtree Road NE Suite 1400 Atlanta, GA 30305-2458, Attention: Marketing Department. Please include a description or copy of the mail marketing you received so we can honor your request.
We describe below the steps you can take to limit tracking of your activities and the delivery of targeted ads in browsers you use to access the Site, certain Offerings and other websites. If you take the steps described below, some cookies and other technologies may still be used to collect information about your interactions with the Site and Offerings for the other purposes described in this Privacy Notice (e.g., enable specific functionality).
Please keep in mind that as the mobile environment continues to evolve, additional opt-out mechanisms or privacy settings may become available to you. We encourage you to review the information on opt-outs and settings that device manufacturers, technology companies and industry associations make available to you.
QGenda does not currently take steps to respond to browsers’ “Do Not Track” signals as no uniform standard to respond to such signals has been developed at this time. We do, however, respond to the Global Privacy Control (“GPC”) to the extent required by applicable law, and allow eligible individuals to convey opt-out preferences when we detect the signal on our publicly available Site. Depending on the nature of your relationship with us and subject to certain exceptions, visitors to the Site, prospective customers or Customer may have certain rights with respect to their personal information.

If you are an individual who has interacted with the Site and you would like to adjust your marketing and advertising preferences, please follow the instructions in the Your Choices, Including Marketing and Interest-Based Ad Opt-Outs section above to modify your preferences.
In addition, if you are individual who has interacted with the Site and are in a jurisdiction with an applicable privacy law, you may have certain privacy rights regarding the personal information we hold about you. These include the rights to access, correct, delete, restrict or object to our use of, or receive a portable copy in a usable electronic format of your personal information. If you would like to update the personal information we hold about you, or exercise your privacy rights, please submit your request by email to legal@qgenda.com and include your full name, postal address, the email address you used to interact with us and specific what rights you want to exercise. Please note that we may require additional information from you in order to honor your request.
We are committed to working with you to obtain a fair resolution in the event you have a complaint or concern about privacy. If, however, you believe that we have not been able to assist with your complaint or concern, you have the right to make a complaint to a data protection authority.

With respect to privacy rights you may have with regards to personal information that our Customers may collect and provide to QGenda for processing as part of the Offerings, please contact the applicable Customer directly to submit your request and/or exercise your privacy rights.
Under the California Consumer Privacy Act of 2018 as amended from time to time (“CCPA”), specific disclosures are required, and eligible California residents have additional rights regarding their personal information. Depending on the nature of your relationship with us and subject to certain exceptions, you may have certain rights.

If you are a Site visitor, prospective customer, or Customer who has interacted with QGenda as part of the contracting process, for marketing purposes, or during the ordinary course of business and you would like to exercise your CCPA rights with respect to the personal information we collected about you, please contact us with your request by email at legal@qgenda.com. For such requests, please put the statement “California CCPA Rights Request” in the body of your email, as well as your full name, California postal address, and the email address you use to interact with us, and specify the CCPA right you wish to exercise. If you submit a request, we may request additional information to enable us to verify your identity and/or process your request.
In addition, certain pieces of personal information that we may have about you may be considered “sensitive” under applicable laws (e.g., account login credentials). Please note that we only process sensitive personal information to provide you with the Offerings.
We use the information you provide to make your CCPA rights requests to verify your identity, locate the personal information we may hold about you and act upon your request. QGenda operates the Site and the Offerings in different regions, including the United States. Personal information collected through the Site and Offerings will be processed in and subject to the laws of the United States, which may not provide the same level of protection for your personal information as your home country. Where applicable, we take steps to comply with applicable legal requirements for the transfer of personal information.
The Site and Offerings are not intended for use by children, especially those under the age of 18, and we do not knowingly collect information from children under the age of 18. If you become aware that your child or any child under your care has provided us with personal information without your consent, please contact us as indicated below. If any information about children is collected through the Offerings, it is up to the relevant Customer to ensure that parental consent or other required permissions have been obtained.
Any dispute concerning the Site or Offerings (including our use of your personal information) will be resolved by the dispute resolution provision and/or other provisions in the applicable Terms Of Service.
We may update this Privacy Notice from time to time to reflect changes in our privacy practices or applicable laws. We may, as permitted by law, make such changes without prior notice. We will publish the updated version on the Site and indicate at the top of the Privacy Notice when it was most recently updated.
